Assessment Collections

Collecting unpaid assessments is one of the most frustrating, time-consuming and yet most important jobs of a Community Association Board of Trustees. We have seven full-time staff members working exclusively on collection matters. Their work includes sending collection letters, filing liens, dealing with Association member bankruptcies, filing money judgment lawsuits. They also stay busy collecting on judgments by way of levies on bank accounts, wage executions and other means. Our attorneys have also been very effective at forcing banks that are foreclosing on vacant properties to pay the ongoing assessments and to force the bank to expedite those foreclosures. While we emphasize the importance of early intervention and being aggressive in collection efforts, we are also cognizant of the fact that, occasionally, there are situations where taking further collection efforts is very unlikely to result in payment. Part of our job as the association's attorneys is to alert the board to those situations in order to prevent unnecessary spending on legal work that is likely to be unproductive.
