Rental Restrictions

In these days of a fluctuating real estate market, with home ownership on the downturn and rental housing on the rise, the issue of restricting the number of rentals in common interest communities is front and center in the minds of the Board members and residents we represent. There are several legal and equitable questions to be addressed before deciding whether or not to impose such restrictions in your community, and if it is decided to move forward with imposing such restrictions, those questions must be properly answered so as to protect the rights and privileges of the Association, its members, and their tenants.
